Sectional Title

Sectional title ownership is becoming increasingly popular and there are over 50 000 schemes, comprising more than 800 000 units in South Africa. The concept is tightly regulated under the recently amended Sectional Title Act and all owners and tenants must be aware that they have specific obligations and responsibilities which are governed by law.

Board of Trustees

Every Sectional Title Scheme in South Africa is mandated to elect a board of trustees who will direct the funds and affirm the policies of the scheme. The Board is elected once a year in general meeting of the Body Corporate and is charged in terms of the Act with the day to day management of Anchors Aweigh. They are responsible for the enforcement of the requirements of the Act as well as the schedule 8 and 9 rules. Although they have far reaching powers in terms of the Act, these power at large relates to the enforcement of the rules of the Body Corporate. Our Board of Trustees is shown below. Management Rules

Management rules deal with matters relating to administration, accounting, insurance, the election of trustees, meetings and the setting and collection of levies. These rules may only be amended by a unanimous resolution of the owners at a general meeting and are mainly concerned with the efficient operation of the scheme. Management rules are generally fairly standard across schemes.

Conduct rules relate to the day-to-day conduct of owners and occupiers and include rules governing pets, parking, waste disposal, washing lines, appearance of buildings etc. These may be amended by special resolution at a general meeting and will differ from scheme to scheme depending on local circumstances. Short Term Letting of Units

There are two principles in sectional title legislation that could have a bearing on short-term letting: they are the nuisance factor and the binding nature of scheme rules.

Let’s look at the rules first. Scheme rules are binding on owners and occupiers of sections, even short-term holiday tenants. It is the duty of the owner to ensure that tenants are aware of and comply with these rules.

An owner may not allow their section to be used in a manner that causes a nuisance or interferes with the use and enjoyment of other sections or the common property. Nuisance is a contentious and subjective topic. Ongoing behaviour that causes quantifiable disruption to the lives of others is unacceptable. A noisy Christmas or New Year’s Eve party in a neighbouring unit is part of life in a community. If these parties happen in the same unit every night for a week, call the police.
